TWO WARETOWN RESIDENTS CHARGED WITH NARCOTICS DISTRIBUTION

Ocean County Prosecutor Bradley D. Billhimer announced that Detectives from the Ocean County Prosecutor’s Office Narcotics Strike Force collaborated with the Ocean Township (Waretown) Police Department Detective Bureau and Patrol Division, as well as the Ocean County Sheriff’s Office K-9 and Field Services Units, to conduct an investigation into the distribution of narcotics in the Ocean County area.  The investigation identified a residence in Waretown as being utilized to store and distribute Methamphetamine and Heroin.

Based on the cooperative investigation, Detectives obtained a court-authorized search warrant for the subject residence in Waretown.  On July 29, 2021, Detectives from the Ocean County Prosecutor’s Office Narcotics Strike Force, Ocean County Regional SWAT Team, Ocean Township Police Department Detective Bureau and Patrol Division, and Ocean County Sheriff’s Office K-9 Unit, executed the search warrant at the residence.  As a result, Detectives seized approximately 40 grams of Crystal Methamphetamine, 20 grams of unpackaged Heroin/Fentanyl, as well as other evidence indicative of narcotics distribution purposes.  Approximately $13,000 in United States currency was also seized by law enforcement.  Arrested were:

Daniel Labiak, 47, of Waretown, charged with Possession of More than One-Half Ounce but Less than Five Ounces of Methamphetamine with Intent to Distribute in violation of N.J.S.A. 2C:35-5b(2); Possession of More than One-Half Ounce but Less than Five Ounces of Heroin With Intent to Distribute in violation of N.J.S.A. 2C:35-5b(2); Possession of Methamphetamine in violation of N.J.S.A. 2C:35-10a(1); Possession of Heroin in violation of N.J.S.A. 2C:35-10a(1); Financial Facilitation of Criminal Activity in violation of N.J.S.A. 2C:21-25a; and Possession of Drug Paraphernalia in violation of N.J.S.A. 2C:36-2a.  Labiak was processed at Ocean Township Police Headquarters, and is presently lodged in the Ocean County Jail pending a detention hearing.

Jaclyn Applegate, 37, also of Waretown, charged with Possession of More than One-Half Ounce but Less than Five Ounces of Methamphetamine with Intent to Distribute in violation of N.J.S.A. 2C:35-5b(2); Possession of More than One-Half Ounce but Less than Five Ounces of Heroin With Intent to Distribute in violation of N.J.S.A. 2C:35-5b(2); Possession of Methamphetamine in violation of N.J.S.A. 2C:35-10a(1); Possession of Heroin in violation of N.J.S.A. 2C:35-10a(1); Financial Facilitation of Criminal Activity in violation of N.J.S.A. 2C:21-25a; and Possession of Drug Paraphernalia in violation of N.J.S.A. 2C:36-2a.  Applegate was processed at Ocean Township Police Headquarters, and released on a summons pending a future court appearance.

Prosecutor Billhimer commends the Ocean County Prosecutor’s Office Narcotics Strike Force, Ocean County Prosecutor’s Office Asset Forfeiture Unit, Ocean Township Police Department Detective Bureau and Patrol Division, Ocean County Regional SWAT Team, and Ocean County Sheriff’s Office K-9 and Field Services Units, for their combined and collective assistance in connection with this investigation.

The charges referenced above are merely accusations and the press and public are reminded that all defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.  R.P.C. 3.6(b)(6).
